In short: Home HVAC Monitor is private personal software, not a public or commercial service. It is provided as-is, it is only a supplemental monitoring tool, and it does not replace professional HVAC service.

1. What this is

Home HVAC Monitor (“the application”) is personal home-automation software written and operated by Jason Bakos (“the owner”) to monitor the heating and cooling systems in the owner’s own home using data from Google Nest thermostats. These terms describe the basis on which the application exists and is used. By using the application or its Google authorization screen you agree to them.

2. Private, personal use only

The application is a private, single-owner tool. It is not offered to the public, has no sign-up or customer accounts, and is not intended for use by anyone other than its owner. It is not a software-as-a-service product, and no one is invited or authorized to use it on their own behalf. The owner may limit or end anyone’s access at any time.

3. No commercial relationship

The application is free, and the owner does not sell it, license it, or offer it for any fee. Nothing about it creates a commercial, customer, employment, agency, or service relationship. There is no support, service-level commitment, uptime commitment, or obligation to maintain, update, or continue the application.

4. Google services and data handling

The application reads data from the owner’s own Nest thermostats through Google’s Smart Device Management API, and the owner’s use of Google services remains subject to Google’s own terms and policies. Google is not a party to these terms and does not sponsor or endorse the application. How the application handles data is described in the Privacy Policy.

5. Provided as-is

The application is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of accuracy, reliability, availability, merchantability, fitness for a particular purpose, and non-infringement.

Readings may be delayed, missing, or wrong. Collection can be interrupted, for example by a network or service outage or an expired or revoked Google authorization, and gaps in the data cannot always be recovered. Calculations, charts, comparisons, and status labels are analytical aids, not measurements certified for any purpose.

6. No guarantee of HVAC accuracy or equipment safety

The application is supplemental monitoring only. It does not control, protect, or shut down any equipment, and it is not a safety system. It is not designed to detect or warn of hazards such as fire, carbon monoxide, refrigerant leaks, electrical faults, water damage, freezing, or overheating, and it must not be relied on for any of them. A status such as “good,” “learning,” or “watch” is not a statement that equipment is safe, sound, or correctly installed.

7. Not professional advice; does not replace HVAC service

The application does not provide professional, engineering, or contractor advice. It does not replace inspection, maintenance, diagnosis, or repair by a qualified, licensed HVAC professional. Decisions about equipment, repairs, warranty claims, or safety should be made with qualified professionals and the equipment manufacturer’s instructions, not on the basis of this application’s output alone.

8. Limitation of liability

To the fullest extent permitted by law, the owner is not liable for any direct, indirect, incidental, consequential, special, or exemplary damages, or for any loss of data, property damage, repair or energy costs, or personal injury, arising from the use of, or inability to use, or reliance on, the application or its output, even if advised of the possibility of such damages. Because the application is free personal software, to the extent any liability cannot be excluded, it is limited to the amount paid for the application, which is zero.

Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law.

9. Changes and discontinuation

The owner may change, suspend, or discontinue the application at any time without notice, and may update these terms by posting a revised version on this page with a new “Last updated” date.
